Marketing, Estate Agency & Domestic Conveyancing
Marketing / Estate Agency and Conveyancing in relation to domestic and commercial premises. As our IT systems are very modern and updated regularly, advertising on our property web pages gives the maximum internet exposure of properties for sale to prospective purchasers.
We are also associate members of the Aberdeen and Moray Solicitors property centres and are able to advertise with them should the client require this. As we are not obliged to advertise in the property centres and only do so if the client wishes, this means that the client remains in control. Our welcoming and spacious office premises have two large display windows which are ideal for advertising property and as they are situated on the main street in Buckie, this affords substantial exposure of properties for sale to prospective purchasers.
Commercial Conveyancing
We are able to submit and receive offers to purchase/sell domestic and commercial property and the firm has long experience of this. Both partners are familiar with the sasine and the land registration system in relation to conveyancing. They are also familiar with agricultural and crofting law. Commercial conveyancing frequently involves purchase/sale of a business (as well as the property itself) and we have considerable experience of corporate law, which includes buying/selling farms, fishing vessels etc.
Wills, Powers of Attorney, Executries and Guardianship Orders
We also deal with Wills, Powers of Attorney and Executries. As far as Wills are concerned, we generally will prepare a Will for a client at no cost to them in situations where the client has either purchased or sold property through us. With the coming into force of the Adults with
Incapacity Act, there has been an increasing need for costly Guardianship Orders in a significant number of cases. We therefore, usually recommend when doing a Will that a client also has a Power of Attorney prepared as it is a lot less costly for the client to have a Power of Attorney prepared whilst they have capacity, than to wait until they do not have capacity and then require to invoke the Court procedure to obtain a Guardianship Order which is much more costly. Mrs Lennon has a great deal of experience in this particular area of law.
Family Law
In addition to the above we also deal with family law which includes matrimonial separation/divorce, dissolution of civil partnerships, pre-nuptial agreements and residence/contact orders in relation to children. Miss Kennedy is a member of the Family Law Association and has a number of years experience in this particular area of law. In line with the guidelines of the Family Law Association she encourages parties to resolve matters outwith the Courts if at all possible. She also encourages Mediation to resolve disputes relating to residence/contact, using Court only as a last resort in order to minimise the cost to the client and also to preserve the relationship between the children and the party with whom they are not resident. This also minimises the stress to clients at a time which could otherwise be very stressful. With the advent of the 2006 Act, which amongst other things has implications for co-habiting couples on separation (whether by death or other reason), there is an increasing need for co-habiting couples to enter into a Minute of Agreement when they commence co-habiting. We would recommend to clients that they enter into such an agreement at the outset as otherwise it could have substantial financial implications for them in the future eg a claim on their estate if they die intestate (without leaving a Will) or a financial claim on them if they separate as a result of the breakdown of their relationship.
Litigation / General Civil Court
We also deal with general Court work and regularly have cases calling in Stornoway, Elgin, Banff, Peterhead and Aberdeen Sheriff Courts. This can be in relation to debt recovery, matrimonial / family law cases, Guardianship Orders etc.
